General Terms and Conditions (GTC)
Introduction and Scope: The following General Terms and Conditions (hereinafter "GTC") govern the relationship between Welldomo Mortgage Brokerage L.L.C and Welldomo Valuation Real Estate L.L.C, located at Emaar Square Building 6, Office 702, Burj Khalifa Community, Dubai, United Arab Emirates (hereinafter "the Company", "we", "us" or "our"), and our clients (hereinafter "the Client", "you" or "your"). By using our services, platforms, or registering for our services, you expressly agree to these GTC. Please read these GTC carefully, as they are binding and set out your rights and obligations. Definitions of Key Terms: - "The Company": Refers to Welldomo Mortgage Brokerage L.L.C and/or Welldomo Valuation Real Estate L.L.C, the provider of the services as described in these GTC. - "Client": Any natural or legal person who uses the Company's services or registers to use our platforms. - "Services": Comprise all services offered, including but not limited to mortgage brokerage, Golden Visa service, bank account opening service, will services, and investment advisory. - "Platforms": All digital channels and means of communication provided by the Company, including the website, social media channels (such as YouTube, Instagram), and newsletter.
Scope of the GTC for All Services and Platforms: These GTC apply to all services offered by the Company worldwide, as well as to all interactions between the Company and its clients, regardless of whether these take place via our website, social media channels, newsletter, or by any other means. By using our services or platforms, you agree to the terms of these GTC. Any deviations from these GTC require the express written consent of the Company. Conclusion of Contract and Description of Services: Our services are availed of through the conclusion of a contract between the Client and the Company. The contract is concluded as soon as the Client requests our services either orally or in writing and the Company agrees to them. Our contracts are concluded either by signature on an order form, in writing by email, or orally by telephone. Our Services Include: Mortgage Brokerage: Regardless of your residency status in the UAE, we offer comprehensive mortgage brokerage. This includes assessing creditworthiness, preparing a financing analysis, and a professional, analytical approach. We guide you through the banks' KYC process, create a profile, communicate with the banks, and support you throughout the entire property purchase process. This includes contract review, the commissioning of appraisers, as well as drawing up powers of attorney and providing authorized representatives for the transaction. Will Services: Through third-party providers, we assist with drawing up wills to safeguard your property in Dubai. Bank Account Opening: Likewise, through third-party providers, we assist with opening bank accounts, both personal and corporate accounts. Golden Visa Service: As a property investor in Dubai, we support you in applying for a Golden Visa or Investor Visa. We review the requirements, prepare all documents for the authorities, and arrange all important appointments such as the medical check and biometrics. We are also responsible for all required documents and accompany you to all appointments. Obligations and Responsibilities of the Parties: It is incumbent upon the Company to provide all services in accordance with the agreed terms and standards. This includes appropriate advice and support for the Client as well as the provision of high-quality services. The Client is obliged to provide the Company with accurate and complete information required for the provision of the services. This includes, but is not limited to, personal and financial information as well as documents needed to process the respective services. Please note that, in providing its services, the Company cooperates with third parties such as banks and authorities. However, the Company assumes no responsibility for delays or damages arising from the acts or omissions of these third parties. The Company is not liable for delays on the part of these third parties and provides no compensation for any resulting damages or losses. Prices, Payment Terms, and Fees: The Client's payment obligation takes effect immediately upon the conclusion of a written or oral contract with us. The payment term for all services rendered is immediately upon receipt of the invoice. Please note that services are only rendered after payment has been received. We offer our clients the option of making payments either to a Euro account within the EU or to a Dirham account in the UAE. We also work with an instant payment provider to facilitate and speed up certain payments during the service process. The fees charged by this provider are borne by us and are not passed on to the Client. For our service, we are legally required to levy a value added tax (VAT) of 5% on the total cost. This VAT is added at the time of invoicing and is attributable to our fee. In the event that the financing request is rejected by the bank after an application has been submitted, we will fully refund the following payments: translation costs and the bank application fee (if charged by the bank). Payment Default and Suspension of Service Provision: If the Client defaults on the payment of a fee due and fails to meet their payment obligation even after a written reminder from the Company and the expiry of a reasonable grace period, the Company is entitled to suspend the provision of all services immediately. This expressly applies not only to the service directly affected by the payment default, but to all ongoing services and contractual relationships between the Client and the Company. If the Client remains in default of payment despite a reminder and the setting of a deadline, the Company is entitled to terminate the entire cooperation with immediate effect. Further statutory rights of the Company – including claims for damages as well as the enforcement of outstanding receivables – remain unaffected. Intellectual Property and Rights of Use: The Company retains all intellectual property rights, including but not limited to trademarks, logos, content, graphics, and designs presented on our website, social media channels, and other platforms. Any use or reproduction of this content without the express written permission of the Company is strictly prohibited. By accessing our website, social media channels, or other platforms of the Company, users obtain no license or permission to use our intellectual property for commercial or non-commercial purposes. The distribution, modification, transmission, or publication of our intellectual property without our prior written consent constitutes an infringement of our rights and may result in legal consequences. Users are prohibited from reproducing, publishing, distributing, or otherwise using our intellectual property in any form, unless this is done in accordance with the express terms of use or a written agreement with the Company. Any links to our website or our YouTube channel must be reported to us and approved in advance. Unauthorized mentions or links will not be tolerated and may lead to legal action. Limitations of Liability and Disclaimers: The Company assumes no liability for direct, indirect, incidental, special, or consequential damages arising from the use of our services, platforms, or content, unless required by law. We are not liable for losses or damages caused by the acts or omissions of third parties, including but not limited to the actions of banks, authorities, or other partners with whom we cooperate. We assume no liability for delays, failures, or interruptions in the provision of our services that are beyond our control, including but not limited to technical problems, natural disasters, strikes, or government measures. Furthermore, we disclaim any liability for damages or losses arising from the use of linked websites, social media channels, or other external resources to which our platforms refer. The use of such external resources is at the user's own risk. Cancellation and Termination of Contract: Our contracts are subject to a strict cancellation policy and may be dissolved only in exceptional cases, unless otherwise agreed. Once a service has been commissioned, its implementation begins immediately. Premature termination of the contract without valid legal grounds is not permitted and is subject to the agreed contractual terms. In the event that a bank account cannot be opened for unforeseen reasons, the amounts paid will be refunded in accordance with the contractual provisions and taking into account a reasonable processing period. Please note that in the event of premature termination of the contract, particularly in the case of a financing request, the total amount of our fee claim that would have arisen in the event of a positive decision by the bank becomes due. For clients who participate in the mentoring program and do not fully avail themselves of the services offered – for example, by failing to ask questions or not booking consultation appointments – no compensation will be paid. Amendments to the GTC: The Company reserves the right to amend or update these General Terms and Conditions (GTC) at any time and at its own discretion. Any amendments to the GTC take effect immediately upon being published on our website or otherwise. Clients will be informed of amendments to the GTC by email or by other appropriate means of communication. It is the Client's responsibility to check the GTC regularly for updates. By continuing to use our services after the amendments take effect, the Client agrees to the updated GTC. Should the Client not agree with the amended GTC, they have the right to discontinue use of our services and to terminate the contract in accordance with the cancellation terms. Applicable Law and Place of Jurisdiction: For all disputes arising out of or in connection with these General Terms and Conditions (GTC), the law of the United Arab Emirates (UAE) applies, to the exclusion of conflict-of-law rules. Any legal disputes arising out of or in connection with these GTC are subject to the exclusive jurisdiction of the courts in Dubai, UAE. In the event of disagreements or disputes between the Client and the Company, it is recommended that all efforts first be made to reach an amicable settlement through conciliation or mediation proceedings. Such proceedings can help resolve conflicts effectively and out of court, saving time and resources for both parties. Communication and Customer Service: Various contact options are available to you for customer inquiries and support. In addition, we also offer the option of communicating via social media channels such as Instagram and YouTube (@dubaifinanz) and via WhatsApp at +971 58 198 6880. We strive to respond to all inquiries and communications as quickly as possible. Notifications and important communications are generally sent by email or telephone, depending on which means of communication is best suited to the respective situation. We recommend that our clients check their emails regularly and ensure that the contact details they have provided are always up to date, in order to guarantee smooth communication. Miscellaneous Provisions: In addition to these General Terms and Conditions, specific services or legal requirements may include additional provisions and conditions that apply to those services or requirements. Such specific provisions will be made available to the Client as needed and apply in conjunction with these General Terms and Conditions. These General Terms and Conditions constitute the entire agreement between the Client and the Company and supersede all prior agreements or arrangements, whether written or oral, relating to the subject matter of this agreement. Any amendments or additions to these terms require the written consent of both parties. Should any provision of these General Terms and Conditions be found to be invalid or unenforceable, the validity and enforceability of the remaining provisions shall remain unaffected.
Data Protection and Data Processing
The Client agrees that all personal data, documents, and other information transmitted or made available in the course of the business relationship – regardless of the form of transmission (e.g., by email, online form, upload, messenger service, or telephone) – may be stored, processed, and analyzed by Dubai Finanz (a brand of Welldomo Mortgage Broker LLC and Welldomo Valuation Real Estate LLC). Processing is carried out exclusively for the purpose of individual advice, support, and performance of the requested services in connection with real estate investments, financing, or other services we offer. The analysis of the data may also be carried out automatically in order to provide the Client with the best possible recommendations and tailored solutions. Processing and storage are carried out in accordance with the applicable data protection regulations of the United Arab Emirates. Disclosure to third parties takes place only insofar as this is necessary to fulfill the purpose of the contract (e.g., to banks, authorities, cooperation partners within the corporate group) or the Client has expressly consented to it. The Client has the right at any time to request information about the data stored about them, as well as to request its correction or deletion, provided that no statutory retention obligations preclude this. Transmission to other third parties or for advertising purposes takes place only with your express consent. We protect your data through appropriate technical and organizational measures, including encrypted connections (SSL), access restrictions within our systems, and secure storage on selected servers. The security of your information is our top priority. You have the right at any time to request information about the data we have stored, to have inaccurate information corrected, or to request the deletion of your data, provided that no statutory retention obligations preclude this. In addition, you have the right to restrict or object to the processing, as well as – insofar as technically possible – to request the transfer of your data to another service provider. To exercise these rights, an informal notice to service@dubai-finanz.de is sufficient. We reserve the right to request proof of identity for verification purposes. When you visit our website, we use cookies and comparable technologies to improve user-friendliness and the quality of our offerings.
